Terms of Service

1. Acceptance of Terms

By accessing or using DartUp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

DartUp is a deployment platform that allows users to deploy web applications and services through Claude Code. We provide hosting, SSL certificates, and subdomain management for deployed applications.

3. User Accounts

You must sign in with a valid Google account to use the Service.

You are responsible for maintaining the security of your account and API keys.

You must not share your API keys with unauthorized parties.

You must be at least 13 years old to use this Service.

4. Acceptable Use

You agree not to use the Service to:

  • Deploy malicious software, malware, or viruses
  • Host phishing sites or fraudulent content
  • Distribute illegal content or engage in illegal activities
  • Perform cryptocurrency mining
  • Send spam or bulk unsolicited messages
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others

5. Resource Limits

Free Tier: 1 project, 1 API key, basic resource allocation.

Pro Plan ($9/month): 5 concurrent projects, unlimited API keys, daemon deployments, persistent volumes.

We reserve the right to terminate or throttle deployments that consume excessive resources or negatively impact other users.

6. Payment and Billing

Pro Plan subscriptions are billed monthly through Stripe.

You may cancel your subscription at any time. Access continues until the end of the billing period.

We do not offer refunds for partial months of service.

Prices may change with 30 days notice.

7. Intellectual Property

You retain all rights to the code and content you deploy through our Service.

We do not claim ownership of your deployments or source code.

The DartUp name, logo, and Service are our intellectual property.

8. Termination

You may delete your account at any time from your dashboard.

We may suspend or terminate accounts that violate these terms.

Upon termination, your deployments will be stopped and data deleted within 30 days.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UPTIME, AVAILABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. USE AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARTUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

11. Indemnification

You agree to indemnify and hold harmless DartUp from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

12. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or through the Service.

13. Governing Law

These terms shall be governed by the laws of the United States, without regard to conflict of law provisions.
